المسؤولية الجزائية لانتهاك البيانات ذات الطابع الشخصي

Abstract

تعد البيانات ذات الطابع الشخصي من أبرز وأهم مظاهر الخصوصية، لذلك رفعتها الدساتير إلى مكانة الحقوق الأساسية وحمتها التشريعات من كل أشكال الانتهاك والاعتداء كقيمة متميزة عن باقي الحقوق تستوجب توفير الحماية القانونية اللازمة، ورغم ما سنة المشرعون من قوانين تجرم المساس بهذه البيانات الشخصية إلا أن الأمر لا يخلو من كثرة الاعتداءات التي تطالها بحيث أصبح التعامل فيها سلعة لما يعرف بتجارة البيانات لا سيما مع سوء استغلال التقدم العلمي في هذا المجال. ولم يكن التصدي لهذه الانتهاكات فعالا على مستوى التشريعات إلا بوضع أطر قانونية تنظم المسؤولية الجزائية عن انتهاك البيانات الشخصية، فكانت هذه الدراسة لمعالجة أحكام وأطر هذه المسؤولية عبر عدة تشريعات مع التركيز على التشريع الجزائري، واقتضى البحث في موضوع المسؤولية عن جرائم البيانات الشخصية أن تبرز الدراسة القيمة أو المصلحة المنتهكة في هذه الجرائم فتطرقت بذلك إلى الإحاطة بمفهوم البيانات الشخصية كحق متميز يكون محلا لهذه الاعتداء في هذه الجرائم، لتعالج الدراسة إثر ذلك إسناد المسؤولية الجزائية عن هذه الجرائم إلى مختلف الفاعلين في مجال البيانات الشخصية وكيف تعاملت التشريعات تجاه جانب إسناد هذه المسؤولية . كما أحاطت الدراسة بصور الاعتداءات المجرمة التي تؤدي إلى قيام المسؤولية الجزائية ضد مرتكبي جرائم البيانات الشخصية لتبين تنوع هذه الاعتداءات واختلاف صورها، ولما كانت العقوبات جانبا مهما في موضوع المسؤولية، كونها الأثر المترتب عن قيامها والجزاء الذي يردع به منتهكو البيانات الشخصية كان لا بد من الإلمام بمختلف العقوبات التي سنتها التشريعات لمواجهة كافة أشكال الانتهاكات ثم الإحاطة بما يؤثر في هذه العقوبات من ظروف تلحق بالجرائم. Personal data is one of the most prominent and significant aspects of privacy. As such, constitutions have elevated it to the status of fundamental rights, and legislation has protected it from all forms of violation and infringement, recognizing it as a distinct value separate from other rights that warrants necessary legal protection. However, despite the laws enacted by legislators to criminalize any breach of this personal data, violations remain widespread. In fact, the handling of personal data has become a commodity in what is known as the "data trade," especially with the misuse of scientific advancements in this field. Addressing these violations effectively at the legislative level has only been possible through the establishment of legal frameworks regulating criminal liability for breaches of personal data. This study, therefore, aims to examine the provisions and frameworks of such liability across various legislations, with a focus on Algerian law. Exploring the issue of liability for crimes related to personal data required highlighting the value or interest violated in these crimes. Thus, the study addresses the concept of personal data as a distinct right, which is the target of such infringements in these crimes. Subsequently, the study examines the attribution of criminal liability for these offenses to the various actors involved in the field of personal data and how legislations have approached this aspect of liability. Furthermore, the study explores the forms of criminalized violations that give rise to criminal liability against perpetrators of personal data crimes, demonstrating the diversity and varying forms of these violations. Finally, since sanctions are a crucial aspect of liability, serving as the consequence of its establishment and as a deterrent against personal data violations, it was essential to review the different sanctions enacted by legislations to address all forms of violations, as well as the circumstances that may influence these sanctions depending on the nature of the crimes.
