علاقة الحماية القانونية لحقوق الملكية الصناعية بالتطور الاقتصادي

Abstract

إن قوانين حماية الملكية الصناعية لا تعمل على تشجيع الاستثمارات الاجنبية فقط بل والمستثمر المحلي داخل دولته بدلا من استثماره بالخارج، ولتميّز حقوق الملكية الفكرية بالعالمية، الشيء الذي جعل حمايتها في إطار الحدود الوطنية غير كافية، لذلك عمدت الدول إلى إيجاد آليات تعمل من خلالها على تفعيل الحماية الدولية لحقوق الملكية الفكرية بصفة عامة والملكية الصناعية بصفة خاصة. وهو ما توصلنا إليه في الأخير، ورغم صعوبة الربط المباشر بين حماية حقوق الملكية الصناعية ونمو الاقتصاد، الا أن توافر الحماية قد يزيد من قيمة الاصول التي تمتلكها الشركات الاجنبية، خاصة ما يتعلق بالتكنولوجيا، الأمر الذي يزيد من حجم الطلب على الاستثمار الأجنبي والمحلي، أي أن توافر الحماية قد تزيد فرص تطوير الاستثمارات. This is what we have reached in the end, and despite the difficulty of direct linking between the protection of industrial property rights and the growth of the economy, the availability of protection may increase the value of assets owned by foreign companies, especially with regard to technology, which increases the volume of demand for foreign and domestic investment, i.e. That the availability of protection may increase opportunities for investment development.
