Abstract

A pharmaceutical patent is a certificate issued by the competent administrative authorities that grants it to the inventor of his medicinal invention after he fulfills the objective and formal conditions specified by law, which authorize him to adhere to the legal protection of his medicinal invention in the face of third parties from the infringement that inflicts the right of the drug patent as a result of the legally criminal acts specified by law , However, the legislator addressed these crimes through civil and criminal protection, in addition to the state’s accession to international treaties and conventions that provide protection to the inventor, such as the TRIPS Agreement and Paris and the WIPO and Washington conventions, in return for the inventor of the drug respecting all objective standards and special formal procedures Pharmacological innocence, otherwise it would be liable to invalidity, The patent shall also expire by forfeiture if special conditions are taken into account that would guarantee him protection in the right to a pharmaceutical patent.
