Abstract

في سياق مشاركة الموظفين في إدارة حياتهم المهنية، يتم إنشاء لجنة إدارية متساوية الاعضاء. هذه الأخيرة هي هيئة استشارية أنشأتها أنظمة الوظيفة العمومية، والغرض منها هو إشراك الموظف في إدارة مساره المهني، والتطبيق الجيد للنصوص القانونية، وضمان أن تكون السلطة التقديرية عادلة وفقًا للضوابط والإجراءات، لها دور قانوني مهم في إدارة حياة الموظف العام بشكل مهني، والذي يشكل أحد الضمانات المهمة في مجال المساءلة التأديبية، وتهدف هذه الدراسة الى تبيان الصلاحيات والاختصاصات المخولة لهذه اللجنة، وكذا دراسة القوة القانونية للآراء التي تصدر عنها في مختلف القضايا المطروحة عليها، وخلصنا في نهاية هذه الدراسة إلى أن اللجنة الادارية متساوية الأعضاء لها دور مهم وفعّال في تسيير المسار المهني للموظف، وتحقق مبدأ الديمقراطية الذي يتجسد من خلال حق الموظفين في المشاركة في تنظيم أمورهم وما يصدر باسمهم من آراء، كما نجحت في الوصول لتحقيق عدة نتائج مرضية من نشاطها الهادف لتسيير حياة الموظف داخل قطاع الوظيفة العمومية . In the context of employee participation in the management of their careers, an equal-member administrative committee is created. The latter is an advisory body created by the civil service systems, the purpose of which is to involve the employee in the management of his career, good application of legal texts, and to ensure that the discretionary authority is fair in accordance with the controls and procedures, having an important legal role in managing the life of the public employee professionally, which is one of the important guarantees in the field of disciplinary accountability, this study aims to show the powers and competencies of this committee, as well as a study of the legal force of opinions issued by it in the various issues before it, and we concluded at the end of this study that the administrative committee is equal to Members have an important and effective role in managing the career path of the employee, and realize the principle of democracy, which is embodied through the right of the employees to participate in organizing their affairs and the opinions issued in their name, and it has succeeded in achieving several satisfactory results from its activities aimed at managing the life of the employee within the public job sector.
